Attorney Benefits and Fee Schedule

With Legal Club:

  • You designate the law specialties for which you desire to receive client referrals.
  • You are free to decline a case at your discretion (refer to Miscellaneous Information, Item 1 of the Fee Schedule). Refer member back to Legal Club’s Member Services Department at 800.305.6816 for another referral.
  • You have sole responsibility for providing legal services to the client – Legal Club is not a law firm.
  • Clients contact and pay you directly.
  • There is no limit to the amount of hours that you can charge for the legal care you provide.
  • If a partner, associate or employee of your firm works on a client’s case, additional hourly charges (not to exceed the applicable reduced hourly rate) may be charged to the client.
  • You may collect and work from a refundable retainer (calculated based on applicable reduced hourly rate).
  • You may charge a flat fee (calculated based on applicable reduced hourly rate).
  • You may elect to participate in one or both programs.

 

Individual / Family Legal Plan

Reduced Hourly Rate:

After an initial free consultation over the phone or in person, plan attorneys will provide extended legal service, including in-court representation (where applicable), at the reduced hourly rate 40% off their normal hourly rate, with a minimum of $125 per hour, for legal care beyond the free and discounted services.

 

Free Services*:

  • One initial phone or face-to-face consultation during normal business hours for each new legal matter.
  • Review of legal documents (6 page maximum) - one per new legal matter. Note that review and/or modification of any pages above and beyond the maximum of 6 pages or subsequent documents that are part of an ongoing case are not included and would be billed out at the applicable reduced hourly rate.
  • Make the initial telephone call or write a letter on behalf of a client for a new legal matter, when determined appropriate by attorney in their professional judgment (independent of ongoing case).
  • The drafting of a “simple will”, along with annual updates.

*Plan Attorneys may collect a retainer from the member prior to providing some of the free member benefits.

Contingency Fee Discounts:

Plan attorneys provide a 10% reduction on contingency fees either from the state maximum rate or the attorney’s usual rate, whichever results in a lower rate. For example, a 40% contingency fee rate would be reduced by 10% to 36%.

 

Small Business Legal Plan

Reduced Hourly Rate:

After an initial free consultation over the phone or in person, plan attorneys will provide extended legal service, including in-court representation (where applicable), at the reduced hourly rate 40% off their normal hourly rate, with a minimum of $125 per hour, for legal care beyond the free and discounted services.

 

Free Services*:

  • One initial phone consultation during normal business hours for each new legal matter.
  • One initial face-to-face consultation (up to a 30 minute time limit) during normal business hours for each new legal matter. The applicable reduced hourly rate would apply to any time beyond 30 minutes.
  • Review of 5 independent documents each quarter with a 10 page maximum each. Review and/or modification of any pages beyond 10 pages or subsequent documents that are part of an ongoing case are not included and would be billed out at the applicable reduced hourly rate.
  • Initial telephone call on behalf of a client’s business for each new legal matter, when determined to be appropriate by the plan attorney in their professional judgment. Unless otherwise indicated, limit of two (2) telephone calls per month. Follow up calls are made at the applicable reduced hourly rate.
  • Initial letter written on behalf of a client’s business for each new legal matter, when determined to be appropriate by the plan attorney in their professional judgment. Unless otherwise indicated, limit of three (3) written letters per month. Follow up letters are prepared at the applicable reduced hourly rate.
  • Initial collection letters are limited to one (1) per new legal matter for a maximum of 10 independent legal matters per quarter. Additional charges begin at the onset of follow up at the applicable reduced hourly rate, or at the contingency fee percentage.
  • Become the registered agent for the business in the state in which it was incorporated.

 

*Plan Attorneys may collect a retainer from the member prior to providing some of the free member benefits.

 

Contingency Fee Discounts:

For collections matters, plan attorneys will accept 18% if the case is settled before formal court proceedings begin and 27% after proceedings begin. Discounted rates are not to exceed state maximums where applicable.

 

For all other contingency fee matters, plan attorneys will provide a 10% reduction on either the state maximum rate or the attorney’s usual rate, whichever results in a lower rate. For example, a 40% contingency fee rate would be reduced by 10% to 36%.

 

Definitions for Discounted Services

If a legal service does not fit within the definitions below, please bill members at the applicable reduced hourly rate. Court costs, filing fees, and travel time are all billed additionally. Retainers or flat fees can be charged under the plan as long as the cost is calculated using the applicable reduced hourly rate. Disregard any service that does not pertain to your firm.

 

CHAPTER 7 BANKRUPTCY ($995.00):

  • The discounted fee includes the preparation of a regulatory petition, preparation and review of the required bankruptcy documents and scheduling of a 341 hearing.
  • To qualify for this special rate, the member's (i.e., debtor's) income cannot exceed the state's median income in which the bankruptcy is being filed. In situations where the debtor's income is greater than the state's median income, all bankruptcy work will be done at the applicable reduced hourly rate.
  • Court costs, filing fees, and other costs such as attorney travel are additional. Court appearances by a plan attorney will be billed at the applicable reduced hourly rate.

 

UNCONTESTED DIVORCE ($750.00)

  • Plan attorney will consult with member to review if matter qualifies as an Uncontested Divorce. If matter qualifies, attorney will review, prepare and file any documents and/or petitions necessary for an uncontested divorce.
  • To qualify for an uncontested divorce, the plan member's spouse is not represented by separate counsel, the member and spouse have no children under 18 (or dependent children of any age), marital assets are less than $70,000, and all issues must be agreed upon by both parties using the same attorney.
  • This fee does not include court appearances, attendance at mediations, court costs, filing fees, the attorney's travel time to and from the courthouse or the preparation of documents affecting the disposition of property. All work that does not meet this definition will be billed at the applicable reduced hourly rate..

 

NON-PAYMENT OF COURT ORDERED SUPPORT ($1,250.00)

  • In previously court ordered support issues, if the individual ordered to comply with the court order is not complying resulting in non-payment of support, whether child support or spousal support, plan attorney will consult with the member and prepare the motion and the affidavit.
  • This fee does not include establishing a support order, court appearances, attendance at mediations, court costs, filing fees, or the attorney’s travel time to and from the courthouse. All work that does not meet this definition will be billed at the applicable reduced hourly rate.

 

RESIDENTIAL REAL ESTATE DOCUMENT REVIEW ($350.00)

  • Includes attorney review of purchase or sales agreement, review of documents prepared by licensed real estate agent or broker (disclosure, title policy, liens, inspection reports, closing cost estimates and statements, etc.), and presentation of detailed guidelines of the closing process for primary residential real estate not used for business or investment purposes.
  • Any additional work or extended counseling will be billed at the applicable reduced hourly rate.

 

SIMPLE WILL WITH MINOR’S TRUST ($300.00)

  • The discounted fee includes the preparation of a simple will with a minor’s trust for the surviving minor children of the plan member.
  • This document will contain information necessary for the creation of a trust in the event that any of the minor children of the plan member have not attained the age of majority at the time of the death or administration of the estate of the member. In such event, the purpose of such trust is to allow the member to designate a trustee to manage the share of the property and assets left to such children, for the benefit of those children, until such time as they have attained the age of majority.
  • This fee does not cover extensive information regarding retirement plans, investments and their tax treatment, other kinds of trusts, complex tax matters, or estate planning. Counsel for these additional areas of law will be billed at the applicable reduced hourly rate.

 

SMALL BUSINESS INCORPORATION ($750.00)

  • The attorney will consult with the member to discuss and address the type of business entity recommended by the member's CPA or tax advisor. Should the member choose to set up a Corporation or Limited Liability Company (LLC), plan attorneys will prepare the necessary documents (Articles of Incorporation if setting up a corporation, or the Articles of Organization if setting up an LLC) for filing with the appropriate agency in their state. This also includes attorney review of the prepared filing of a 1120s election form and SS-4 application for the Federal identification number prepared by the CPA or tax advisor.
  • Not for profit organizations, partnerships and limited liability partnerships (LLP) are not included in this definition; plan attorneys can assist members choosing to form the excluded entities at the applicable reduced hourly rate. Filing fees, duplication costs, photo copies, the corporate kit and all expenses are paid by the member. NOTE: Extended legal work for the newly formed corporation is not eligible for the Individual/Family Legal Plan discount; enrollment in Legal Club’s Small Business Plan is required for extended legal work.

 

TRAFFIC TICKET DEFENSE ($89.00)

  • The discounted fee applies to first time non-criminal traffic infractions including but not limited to, violation of traffic control device, failure to stop at a stop sign, improper change of lane, illegal turns, improper or unsafe equipment, expired tag, no proof of insurance, unlawful speed, improper passing, failure to use turn signal, failure to yield the right of way and safety belt violations.
  • The special privileged rate applies to each individual non-criminal traffic infraction. The discounted fee includes the preparation of any necessary court documents and attendance at a single court hearing to settle a single, first time, non-criminal traffic infraction.
  • The discounted fee does not include court costs, fines imposed by the presiding judge, additional scheduled hearings or other traffic matters deemed to be criminal in nature.

 

OTHER DEFINITIONS

 

ELIGIBLE FAMILY MEMBERS:

  • The member’s spouse or domestic partner, dependent children, and dependent individuals living in the plan member’s home such as a parent or grandparent.

 

PLAN MEMBER:

  • Any person who has enrolled with Legal Club of America® and has a current paid membership.

 

PLAN/PARTICIPATING ATTORNEYS:

  • Attorneys are licensed and in good standing and qualified to practice law in their respective state(s), required by the company to maintain professional liability insurance, if required by their state, and have contracted with Legal Club of America® to provide legal services to plan members as outlined in this fee schedule for the cases that they accept.

 

SIMPLE WILL (FREE):

  • A will distributing personal property and homestead and not involving trusts, specific bequests, investment real estate, tax matters, guardianships, living wills, health care proxies or partitions.

 

MISCELLANEOUS INFORMATION

  1. Plan/participating attorneys are bound by their state’s professional code of ethics. Plan attorneys will advise plan members and Legal Club if they have a conflict of interest in taking a plan member’s case. Plan attorneys have the inherent right to decline a case for any reason. However, plan attorneys shall not reject any eligible plan member seeking services by reason of the amount of fees to which he or she may be entitled to charge under the Legal Club of America® attorney fee schedule or corresponding plan member guidebook. If a case is rejected, plan attorneys are responsible to refer plan member back to Legal Club’s Member Service Center toll-free at 800 305-6816 for assistance to locate another plan attorney to assist them with their legal matter.
  2. The plan member pays attorney fees directly to the plan attorney. Participating attorneys are not employees of Legal Club of America® and have no financial obligation to the company.
  3. Legal Club of America® is not liable to indemnify or reimburse any plan attorney or plan member for any attorney fees or costs generated by the plan member.
  4. The penalty for deceiving the Legal Club or any plan attorney for the purpose of utilizing the plan for a non-eligible family member is automatic termination of plan privileges and immediate notification to the plan attorney about the termination.
  5. The plan attorneys in their attorney/client relationship have the sole responsibility for providing legal services to the plan member.
  6. Legal Club of America Corporation is not a law firm, insurance carrier or a provider of legal services.
  7. Court costs, expert witness fee, filing fees, court reporter fees, transcript expenses, travel expenses to and from court, photocopying costs, postage, telephone toll charges and any other incidental expenses incurred by the plan member are excluded from discounted rates under any of the discounted pricing described in this fee schedule.
